1. About This Privacy Policy

AM Advisory (“we”, “us”, “our”), trading name of AM Business & Taxation Pty Ltd (ABN 27 610 871 933), is committed to protecting and properly handling the personal information you trust us with. This Privacy Policy explains what personal information we collect, and how we collect, hold, use and disclose it, in accordance with the Privacy Act 1988 (Cth) (“Privacy Act”) and the Australian Privacy Principles (APPs). It applies to information collected through our website (https://amadvisory.com.au) and in the course of providing our accounting, taxation, bookkeeping, payroll, business advisory and finance/lending services.

2. What You Need to Know

3. Collection, Use and Sharing of Personal Information

3.1 Why We Collect Your Information

We collect personal information to enable us to provide accounting, taxation, bookkeeping, payroll, business advisory and finance broking services to you. If you choose not to provide information we reasonably need, we may be unable to provide some or all of our services to you.

3.2 How We Collect Your Information

We collect personal information directly from you, for example when you:

  • Enquire about, or apply for, our accounting, tax, advisory or lending services;
  • Complete a contact, enquiry or subscription form on our website;
  • Are a party to a loan or finance application, such as a co-applicant, guarantor, or director or trustee of a corporate or trust applicant;
  • Give us feedback or make a complaint; or
  • Speak with us by phone, email, or in person.

We may also collect information about you from other sources, such as:

  • Your representatives, such as a solicitor, conveyancer, or referring adviser;
  • Joint applicants, co-applicants or guarantors;
  • Referral partners;
  • Publicly available sources, such as public registers (e.g. ASIC) or social media;
  • Your employer, where relevant to income verification; and
  • Credit reporting bodies and lenders, where relevant to a finance application.

If you give us personal information about another person (for example, a co-applicant or guarantor), you confirm that you are authorised to do so and agree to inform that person of the content of this Policy.

The personal information we may collect includes:

  • Personal and contact details — name, address, email, phone number, date of birth;
  • Identity documents — Australian or foreign identity documents such as a driver licence, passport, or Medicare card, ABN and company details;
  • Financial information — employment, income, assets and liabilities, and documents to verify these such as payslips, tax returns, financial statements, bank and loan statements;
  • Tax File Number (TFN), where relevant to the taxation or accounting services provided;
  • Credit information — see section 5.3 below;
  • Website usage information — such as IP address, browser type, pages visited and referring website, collected automatically via cookies and analytics tools (see section 5.4); and
  • Any other information you choose to give us, for example through an enquiry form, email, or phone conversation.

3.3 How We Use Your Information

We use your personal information to:

  • Verify your identity and assess your eligibility for our services or a lender’s products;
  • Prepare, assess and lodge tax returns, financial statements, and other documents with the Australian Taxation Office (ATO) and other regulators on your behalf;
  • Assess, process and submit finance or credit applications to banks and other lenders;
  • Communicate with you, including responding to enquiries and providing updates on your matter;
  • Manage our relationship with you or your business, and improve our services;
  • Meet our legal, regulatory and professional obligations, including under taxation, anti-money laundering, and credit legislation; and
  • Where you have opted in, send you newsletters or marketing communications about our services.

You can opt out of marketing communications at any time — see section 5.2 below.

3.4 Who We Share Your Information With

We will never sell your personal information. We may share your information with:

  • Banks, lenders, aggregators and other credit providers, for the purpose of assessing and processing a finance application. If your information is used for a credit application, the lender may record a credit enquiry against your file and report details to a credit reporting body;
  • Credit reporting bodies (see section 5.3);
  • The Australian Taxation Office and other government, regulatory or law enforcement bodies, as required or authorized by law, including the Australian Transaction Reports and Analysis Centre (AUSTRAC) for anti-money laundering and counter-terrorism financing purposes (see section 5.6);
  • Third parties you have authorized us to share information with, such as your accountant, solicitor, financial adviser, or a person holding your power of attorney;
  • Co-applicants, joint applicants, or any person who guarantees or proposes to guarantee credit provided to you;
  • Our service providers, such as software, cloud hosting, IT, and mailing providers who help us run our business, and who are bound by confidentiality obligations; and
  • Our auditors and insurers, or organizations that help us identify, investigate or prevent fraud or misconduct.

Before sharing your information with a third party, we take reasonable steps to check that party is appropriate to receive it.

3.5 Location of Information We Hold About You

We use a number of software and cloud-based platforms to run our business and hold your information, including Xero, myCRM, Microsoft Outlook, Microsoft OneDrive, and the ApplyOnline loan aggregation platform. Some of these providers may store or process data on servers located outside Australia. Where this occurs, we take reasonable steps to ensure appropriate data handling and security arrangements are in place. Overseas recipients may be subject to the laws of their own country, which may require them to disclose information in circumstances different to Australian law.

4. Holding and Protecting Your Information

We take a number of steps to protect the personal information we hold, including:

  • Confidentiality obligations on our staff and contractors;
  • Secure, password-protected storage of electronic files and restricted access to client records;
  • Physical security measures for any paper files, until they are securely digitized or destroyed; and
  • Use of reputable, industry-standard software platforms for client and financial data.

No method of electronic storage or transmission is completely secure, and we cannot guarantee absolute security. If you believe your information has been compromised, please contact us immediately using the details in section 8.

We keep your personal information for as long as you remain a client, and generally for a further period afterwards to meet our legal and regulatory record-keeping obligations (accounting and taxation records are typically required to be kept for at least five years, and credit-related records for longer periods in some cases). We may retain information for longer where reasonably necessary to resolve a dispute, complaint, or legal requirement. When we no longer need your information and are legally permitted to do so, we take reasonable steps to destroy or de-identify it.

5. Other Relevant Matters

5.1 E-Consent

By providing your email address and submitting any form, application, calculator, or enquiry on our website, you acknowledge that we may communicate with you and share documents electronically rather than by paper. You should check your email regularly. You may withdraw your consent to receive documents electronically at any time by contacting us.

5.2 Opting Out of Direct Marketing

You can ask us to stop sending you direct marketing at any time, at no cost, by:

  • Contacting us using the details in section 8;
  • Using the unsubscribe link included in our marketing emails; or
  • Speaking with your usual contact at AM Advisory.

We will process your request as soon as reasonably possible.

5.3 Credit Information

Where you apply for finance through us, we collect, use and disclose credit information about you (a sub-set of personal information, which may include your credit history, repayment history, and any defaults) in accordance with Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code.

You authorize us to obtain a copy of your credit report from a credit reporting body as an “access seeker” — this type of enquiry does not appear on your credit report or affect your credit score. You consent to us providing information in that report to lenders you authorize us to approach on your behalf, for the purpose of assessing your application.

You have the right to request access to the credit information we hold about you, and to ask a credit reporting body to correct information it holds, or to note that you may have been the victim of fraud. The credit reporting body we work with is Equifax (www.equifax.com.au); you may contact them directly for further information about your credit report.

5.4 Cookies and Website Analytics

Our website may use cookies and similar technologies (such as Google Analytics) to help us understand how visitors use the site and to improve your experience. A cookie is a small text file stored on your device. When you visit our website, our systems may record your IP address, the date and time of your visit, the pages you viewed, and any information you submit or download. You can configure your browser to refuse cookies, though this may limit some functionality of the Website.

5.5 Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF)

AM Advisory is enrolled with the Australian Transaction Reports and Analysis Centre (AUSTRAC) as a reporting entity under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (“AML/CTF Act”). Before we can provide certain services, we are legally required to identify and verify who you are (and, where relevant, any beneficial owners of an entity you represent), using reliable and independent documents or electronic data — for example, a driver license, passport, Medicare card, or company/trust documents.

For this purpose, we may:

  • Collect and verify identification and beneficial ownership information about you before, or while, providing a service;
  • Carry out ongoing customer due diligence and monitor transactions and instructions for the life of our relationship with you;
  • Screen your details against sanctions lists and politically exposed persons (PEP) databases, including using third-party identity verification services;
  • Disclose information to AUSTRAC, including filing suspicious matter reports, threshold transaction reports, or other reports required under the AML/CTF Act; and
  • Retain records collected for AML/CTF purposes for at least seven years, as required by law.

We are not permitted to tell you, or any other person, if we have formed a suspicion about a transaction or matter, or if we have made or are considering making a report to AUSTRAC (this is known as “tipping off” and is a criminal offence). We may decline, delay, or discontinue providing a service where we are unable to verify your identity or complete required due diligence, and we will not be liable for any loss you incur as a result of us complying with our AML/CTF obligations.

5.6 Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal and regulatory requirements. The current version will always be available on our Website with an updated “last updated” date, or on request using the contact details in section 8.

6. Personal Information About Employees and Job Applicants

If you apply for a role with us, or become an employee or contractor of AM Advisory, we may also collect personal information from you or your referees for the purposes of:

  • Assessing your application for employment or engagement;
  • Administering your employment, remuneration, and contractual obligations if your application is successful; and
  • Complying with our workplace and regulatory obligations.

If you do not provide requested information in this context, it may affect our ability to properly consider your application.

7. Managing and Accessing Your Information

7.1 Accessing and Correcting Your Information

If your contact details change, please let us know so we can keep your information accurate and up to date. You can request access to, or correction of, the personal information we hold about you by contacting us using the details in section 8. We will generally respond within 30 days. In some cases we may charge a reasonable fee to cover the cost of retrieving more complex records, and we will let you know the likely cost before proceeding. There may be limited circumstances, permitted under the Privacy Act, where we are unable to give you full access; if so, we will explain why.

7.2 Privacy Complaints

If you believe we have breached the Australian Privacy Principles, or have any concerns about how we have handled your personal information, please contact us using the details in section 8 so we can investigate and respond.
